IMO, there is 180 degree difference between legalities and the "emotional" world. I'm sure there could be other situations (even hypothetical) that could be used against a broad ban by Pres. Bush. Not that I would expect that will happen.
I think the courts *do* use other scenarios (no, not whitewashing as you say) to come to logical conclusions. But I'd be happy to admit it if I am proven to be mistaken.
